Proxy and POA

The person granting the power of attorney is usually known as the grantor and the person authorised to act is usually referred to as the proxy. In general, the power granted may be very wide in scope and may include the power to sign documents on behalf of the grantor, deal with their financial affairs and property.

Third parties

To prevent miscommunication and misconceptions of the provided authorisation to the proxy, the scope of the power of attorney is commonly noted down in a written deed or statement, signed by the grantor. This document is then used by the proxy to show third parties that he/she is indeed acting legally on behalf of the grantor. Without legal confirmation, the third party faces the risk that the deeds performed by the proxy on behalf of the grantor could be nullified by the grantor due to the fact the grantor had no authorisation.

Why does one become a proxy for a tenant?

Grantors are tenants who are moving out of their accommodation and do not have the time to be present on the scheduled day and time an inspection will be held. The proxies who are assigned by the tenants are usually roommates, classmates, friends or family.

At the moment it is confirmed that a tenant will move out of his or her accommodation, end inspections will be scheduled. The tenant is provided the information that it is possible to assign somebody else in their place to witness and act on their behalf during the inspections and that this can be done through a power of attorney.

Under the following examples, a proxy can be assigned by a tenant with Beter Beheer B.V.:

  • Performing the Pre-checkout inspection on behalf of a tenant;

  • Performing the Checkout inspection on behalf of a tenant;

  • Receive keys on behalf of a tenant.

How does somebody become a proxy?

The process consists of a few steps.

  1. The dates of the end inspections are confirmed by the tenant.

  2. To appoint a proxy, the tenant must complete an online form with the proxy's name and contact details (phone and email).

  3. The tenant digitally signs a legal document through which the power of attorney is granted to the proxy.

  4. After the document is signed, the proxy will receive an email confirming their appointment and a copy of the signed power of attorney.

  5. The tenant receives the signed document in their email.

What should a proxy do?

First of all, the proxy should be on time for the inspection at the given time and date. Secondly, at the start of the inspection, the proxy should identify him- or herself as the proxy to an employee of Student Housing The Hague. Furthermore, he/she should make statements and sign the documents on behalf of the tenant.

Important information

A power of attorney;

  • cannot be passed further to another person and is without the power of substitution;

  • cannot be withdrawn once the document is signed;

  • is applicable to a certain inspection on a certain date (and time), which means that if the appointment is moved/cancelled, the provided authority should be confirmed again;

  • You may provide your own drafted power of attorney.
